Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (“you”, “your”) and PropBrief.ai (“PropBrief.ai”, “we”, “us”, “our”) governing your access to and use of the website at propbrief.ai and any related services, content, and PDF reports we provide (collectively, the “Service”). By accessing, browsing, registering for, or paying for the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
01The Service
PropBrief.ai operates an automated software system that compiles publicly available information about U.S. residential properties at the address you submit. All data in a Report is drawn from publicly available web sources, including public property records, online real-estate listings, public school and crime data, census and demographic publications, and other openly published market reports. A large language model (currently Anthropic Claude) is used solely to summarize, format, and aggregate that public information into a PDF brief covering estimated values, comparable sales, cash-flow estimates, neighborhood metrics, investment-strategy notes, scenario projections, and risk factors.
PropBrief.ai does not conduct primary research, send anyone to inspect the property, pull non-public databases, or generate any data point from independent investigation. PropBrief.ai does not independently verify, validate, or warrant the accuracy of the underlying public sources or the AI's summary of them.
Reports are not appraisals, inspections, title searches, broker price opinions (BPOs), automated valuation models offered for lending, real-estate brokerage services, investment advice, tax advice, legal advice, or any other regulated professional service. We may modify, suspend, or discontinue any part of the Service at any time without notice.
02Not Professional Advice — Read This Carefully
Reports are provided for educational and informational purposes only and must not be relied upon as a substitute for advice from licensed professionals. Real estate transactions involve significant financial, legal, and tax consequences. Before making any purchase, sale, rental, financing, or investment decision, you must independently verify all material facts and consult qualified professionals, including but not limited to:
- Licensed real estate brokers, agents, and REALTORS®
- Licensed appraisers (for market value)
- Licensed home inspectors (for physical condition)
- Title insurance companies and real estate attorneys (for legal title and encumbrances)
- Mortgage lenders and financial advisors (for financing and affordability)
- Tax professionals (for tax implications)
- Insurance agents (for insurability, flood/fire/wind zones)
You assume full responsibility for any action you take based on a Report. PropBrief.ai is not a real estate brokerage, appraiser, lender, financial adviser, investment adviser, tax adviser, or attorney, and nothing in the Service creates any such relationship.
03Source of Data, AI Limitations, and No Independent Verification
All information in a Report is sourced from publicly available web data. PropBrief.ai does not pay for, license, or independently collect any proprietary or non-public data. The AI may draw from public property records, online listings (e.g., Zillow, Realtor.com, Redfin), MLS data made publicly available by the broker, public school ratings, public crime statistics, U.S. Census data, and other open web content available at the time the Report is generated.
The AI is a summarizer, not an investigator. Reports are generated in whole or in part by artificial intelligence (large language models). AI systems can and do make mistakes, including but not limited to: hallucinating facts (e.g., fabricating comparable sales, school ratings, or addresses), misstating property attributes (bedrooms, square footage, year built, lot size), using stale or incorrect market data, miscalculating financial metrics, and applying assumptions (interest rate, down payment, vacancy, expense ratios) that may not match your situation.
We do not verify the public sources. PropBrief.ai does not call the county recorder, walk the property, contact the listing agent, pull title, or otherwise verify what the AI compiled from the public web. Public sources themselves may be incomplete, out of date, mis-entered, or wrong.
We make no warranty that any specific fact, figure, recommendation, price estimate, comparable sale, neighborhood score, or projection in a Report is correct. The Property Score, Grade, Signal (BUY/HOLD/AVOID), suggested offer range, ROI projections, and scenario outcomes are model outputs intended as journalistic summaries of public signals, not predictions, guarantees, or recommendations to buy or sell any security or real estate. You must independently verify everything material before acting.
04Eligibility
You must be at least 18 years old and legally able to enter into a contract under the laws of your jurisdiction to use the Service. The Service is intended for users located in the United States. You represent and warrant that the information you provide (email, phone, payment details, property address) is true, accurate, and your own.
05Account, Authentication, and Communications
Access is gated by one-time passcodes (“OTP”) sent to the email address you provide. You are responsible for safeguarding your inbox, device, and any OTP delivered to you. Phone numbers are not currently required for authentication; if a phone number is later supplied for optional SMS notification of report delivery, you consent to receive transactional SMS messages related to that order (delivery links, receipts only). Message and data rates may apply. Reply STOP to opt out of further SMS.
By providing an email address, you consent to receive transactional email related to your order (verification codes, receipts, report links). Promotional emails are sent only with your separate consent and may be unsubscribed at any time via the link in each message.
06Payment and Refunds
Reports are sold as a one-time digital purchase at the price displayed at checkout (currently $9.99 USD per Report, subject to change). Payment is processed by PayPal, Inc., subject to PayPal's own terms. We never store full card numbers on our servers.
Refund policy. Because each Report is a custom-generated digital good delivered immediately upon payment, all sales are final and non-refundable once the Report PDF has been generated and made available in your Library. We may, at our sole discretion, issue a refund if (a) payment was captured but no Report was ever generated, (b) the Report contains a critical technical defect that prevents access, or (c) you can show duplicate or fraudulent charges. Refund requests must be submitted within 7 days of the original charge to the contact address below. Chargebacks initiated without first contacting us may result in account termination.
07Intellectual Property and License
The PropBrief.ai name, wordmark, site design, code, prompts, templates, scoring methodology, and the underlying compilation, selection, and arrangement of Report content are owned by us and protected by copyright, trademark, and other intellectual-property laws. Underlying public data (e.g., addresses, public records) is not owned by us.
Upon successful payment, we grant you a limited, non-exclusive, non-transferable, revocable license to download, view, print, and store the Report PDF for your own personal, non-commercial use related to a real or contemplated transaction in which you are personally interested. You may share a Report with your own real estate agent, attorney, accountant, or other advisor for that same purpose. You may not (i) republish, redistribute, resell, sublicense, or syndicate Reports; (ii) scrape, frame, or automate retrieval of the Service; (iii) use Reports or Service output to train any AI/ML system; or (iv) remove or alter any copyright, trademark, or attribution notices.
08Acceptable Use
You agree not to use the Service to:
- Violate any law, regulation, or third party's rights;
- Submit addresses you do not have a legitimate interest in (e.g., to harass, stalk, or compile dossiers on individuals);
- Probe, scan, overload, or attempt to disrupt our infrastructure, or circumvent authentication or rate limits;
- Reverse engineer, decompile, or attempt to extract source code, prompts, or models;
- Misrepresent yourself or use another person's payment instrument, email, or phone without authorization;
- Use the Service in any manner that could create discriminatory steering or violate the Fair Housing Act, the Equal Credit Opportunity Act, or similar state laws.
09Third-Party Services
The Service depends on third-party providers including, without limitation: Anthropic, PBC (AI), Supabase, Inc. (database, storage, edge functions), Vercel, Inc. (hosting), PayPal, Inc. (payments), Resend (email), and Twilio Inc. (SMS). Your use of those providers' services through us is also subject to their own terms and privacy policies. We are not responsible for outages, errors, or actions of third-party providers, but we will make commercially reasonable efforts to mitigate impact.
10Privacy
Our Privacy Policy describes what data we collect (email, phone, payment metadata, the property addresses you submit, IP address, basic usage logs), how we use it, and how we share it. We do not sell your personal information. Property addresses you submit and the Reports we generate may be retained to operate the Service, prevent fraud, fulfill legal obligations, and improve the Service. Account data is deleted on request, subject to legal retention requirements (e.g., transaction records).
11Disclaimer of Warranties
The Service and all Reports are provided “as is” and “as available”, without any warranty of any kind, express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, currentness, reliability, quiet enjoyment, and any warranties arising from course of dealing or trade usage.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any Report is free of inaccuracies. No oral or written information obtained from us creates any warranty not expressly stated in these Terms.
12Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall PropBrief.ai, its affiliates, officers, directors, employees, contractors, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for lost profits, lost revenue, lost opportunity, lost real estate transactions, cost of substitute services, business interruption, or loss of data, arising out of or in connection with the Service or any Report, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Without limiting the foregoing, our total aggregate liability to you for all claims arising out of or relating to the Service, any Report, or these Terms shall not exceed the greater of (a) the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions liability is limited to the maximum extent permitted by law.
13Indemnification
You agree to defend, indemnify, and hold harmless PropBrief.ai and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to reasonable attorney's fees) arising from: (i) your use of or reliance on the Service or any Report; (ii) your violation of these Terms; (iii) your violation of any law or any third party's rights; or (iv) any decision or transaction you enter into, including real estate purchases, sales, financing, or rentals, in connection with information contained in a Report.
14Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including without limitation any breach of these Terms, suspected fraud, chargeback abuse, or prolonged inactivity. Upon termination your right to use the Service ends immediately, but Sections 2, 3, 6 (refund denials), 7, 11, 12, 13, 15, 16, and 17 survive termination.
15Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide additional notice by email to the address on your account or by a prominent notice on the Service. Continued use of the Service after the effective date of revised Terms constitutes your acceptance. If you do not agree to the revised Terms, stop using the Service.
16Governing Law and Venue
These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of Texas, U.S.A., without regard to its conflict of laws principles. Subject to Section 17 below, you and PropBrief.ai agree that the exclusive jurisdiction and venue for any action not subject to arbitration shall be the state and federal courts located in Dallas County, Texas, and both parties consent to personal jurisdiction in those courts.
17Dispute Resolution — Informal Resolution, Arbitration, and Class-Action Waiver
Informal resolution first. Before filing any claim, you agree to first contact us at the address below and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration. Any dispute not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Dallas County, Texas, or by remote/online proceedings at your option. The arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and PropBrief.ai each waive any right to participate in a class action, class arbitration, collective action, or representative proceeding. Disputes must be brought in your individual capacity only.
Exceptions. Either party may bring an individual action in small-claims court, and either party may seek injunctive or equitable relief in court for infringement or misappropriation of intellectual property rights.
30-day opt-out. You may opt out of this arbitration provision by sending a written notice to the contact address below within 30 days of first accepting these Terms, stating your name, email/phone on file, and a clear statement that you wish to opt out of arbitration.
18Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and PropBrief.ai regarding the Service and supersede all prior agreements. If any provision is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign these Terms freely. Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship.

By using PropBrief.ai you acknowledge that you have read these Terms in full, that you understand the limitations described above (including the disclaimer of warranties in Section 11, the limitation of liability in Section 12, and the arbitration/class-action waiver in Section 17), and that you agree to be legally bound by them.
